It really has 39 pieces in the case and the case counts as 40. Their picture has two duplicate "black pastel pencil" ..but there is only one of them. #2. The description of what it contains is wrong as well. It doesn't have "5 chalk paint brushes" or "2 solid paper pens" but instead it has 4 pastel pencils and 2 paper stumps. ~Side note, one of the paper stumps doesn't have it's own slot in the case and doesn't fit in it perfectly.
